Understanding Juvenile Crimes in Colorado
In Colorado, individuals between the ages of 10 and 18 who are accused of crimes are tried as juveniles. Although juvenile crime cases are handled differently than adult criminal cases, those convicted are still subject to significant penalties, including fines, probation, time in a juvenile detention facility, and sometimes jail.
While a juvenile can be charged for any type of crime, there are certain actions that are only constituted as an offense if committed by a minor.
Crimes that are exclusive to juveniles include:
- Curfew violations
- Truancy
- Underage possession of alcohol, tobacco, or marijuana
When a Minor Can be Tried as an Adult
If a child is at least 16 years old, a juvenile court may choose to transfer the case to the district court to have the minor tried as an adult.
There are several factors that determine if a child will be sentenced as an adult, including:
- The child’s age
- The type of crime
- The child’s history of delinquency
- The approval of the district attorney
Aggressive Juvenile Defense for Your Child
A criminal conviction can drastically affect your child’s future. When you turn to Gaddis Law, our top priority is to make sure that your child’s case stays in family court, rather than being transferred to the district court. We then focus our attention on proving your child’s innocence by casting doubt on the prosecution’s evidence. When a case dismissal is not possible, we fight for the minimum possible penalty.
